1. Scope

Harley AI is a state-of-the-art artificial intelligence (AI) dating assistant designed to enhance your online dating experience. It is a product by 1000457500 ONTARIO INC. (“The Company”), which operates the harley.coach website (“Site”), as well as the Harley AI browser extension (“Service”).

This privacy policy explains how The Company uses and protects any information that you provide when you use this Service. By accessing our Service, you consent to the information collection and use practices outlined in this Privacy Policy. Throughout this policy, “Harley AI,” “we,” or “us” refers to 1000457500 ONTARIO INC.

All data subjects whose personal data is collected are protected in line with the requirements of the General Data Protection Regulation (GDPR) and Ontario, Canada law.

If you do not agree with this policy, please do not access or use our Services or interact with any other aspect of our business.

2. Responsibilities

All employees of The Company who interact with data subjects are responsible for ensuring that this notice is drawn to the data subject’s attention and their consent to the processing of their data is secured.

3. Privacy notice

3.1 Collection of information

The personal information we may collect from you includes:

  • Email address;
  • Chat history for generating responses;

You are not required to provide any of this information, but if you don’t, we may not be able to provide you with the requested services. You can stop sharing that information with us at any time by revoking Harley AI’s access to your account.

We do not store your payment information. If you are a paying customer, your credit card details will be directly provided to our payment processor, and their privacy policy will apply to the information you provide on their platform.

Client Identifier: We store a unique client identifier in your browser’s local storage when using our Chrome Extension. This allows us to recognize your device for subsequent visits and to enhance your user experience with the Service. This identifier is solely used for the functionality of the Service and is not tied to your personal identity unless explicitly associated by you.

Chat interactions with the Harley AI dating coach chatbot for the purpose of improving the bot’s responses and understanding user needs.

Automatically collected information

Certain data about the devices you use to connect with Harley AI and your use of the Site and Service are automatically logged in our systems, including:

  • Location information. This is the geographic area where you use your devices when interacting with our Site and/or Services.
  • Log data. As with most websites and technology services delivered over the internet, our servers automatically collect data when you access or use our Site and Service and record it in log files. This log data may include your IP address, browser type and settings, the date and time of use, information about browser configuration, language preferences, and cookie data.
  • Usage information. This information concerns the Harley AI Site and Service you use and how you use them. We may also obtain data from our third-party partners and service providers to analyze how users use our Site and Service. For example, we will know how many users access a specific page on the Site and which links they clicked on. We use this aggregated information to better understand and optimize the Site.
  • Cookies. A cookie is a data file placed on a device when it is used to visit our Site. Cookies may be used for many purposes, including tracking user preferences and web pages visited while using our Site. You may be able to remove, reject, or disable some types of cookies using your browser’s preferences or other programs. Some features of our Site may not function properly or may operate slowly if you disable, delete, or refuse to accept cookies.

The personal data we collect will be used for the following purposes:

  • To administer our Site and Service, authenticate users for security purposes, provide personalized user features and access, conduct research, develop new features, and improve the features, algorithms, and usability of our Site and Service.
  • To communicate with you about your use of our Site and Service, product announcements, and Service updates, as well as respond to your requests for assistance.
  • To display User Content associated with your account and ensure it is available to you when you use our Services.
  • To calculate aggregate statistics on the number of unique devices using our Site, Software, and/or Services, and to detect and prevent fraud and misuse of those.
  • To understand and analyze user behavior, trends, and preferences, improve our Services, and enhance the user experience. This includes recognizing your device across multiple sessions through the client identifier stored in your browser’s local storage.
  • To analyze and improve the responses and effectiveness of the Harley AI dating coach chatbot by understanding user interactions and feedback.

Our legal basis for processing the personal data:

If you have consented to our use of information about you for a specific purpose, you have the right to change your mind at any time, but this will not affect any processing that has already taken place. Where we are using your information because we or a third party (e.g. your employer) have a legitimate interest to do so, you have the right to object to that use though, in some cases, this may mean no longer using the Services.

3.2 Consent

By consenting to this privacy notice, you give us permission to process your personal data specifically for the purposes identified.

By using our Service, especially our Chrome Extension, and consenting to this privacy notice, you give us permission to process your personal data, including the unique client identifier, specifically for the purposes identified.

3.3 Disclosure

We only disclose Personal Data to third parties when:

  • We use service providers who assist us in meeting business operations needs, including hosting, delivering, and improving our Services. We also use service providers for specific services and functions, including email communication, customer support services, and analytics. These service providers may only access, process, or store Personal Data as per our instructions and to perform their duties to us.
  • We determine that the access, preservation, or disclosure of your Personal Data is required by law to protect the rights, property, or personal safety of Harley AI and users of our Site and Service, or to respond to lawful requests by public authorities, including national security or law enforcement requests.
  • We need to do so in connection with a merger, acquisition, bankruptcy, reorganization, sale of some or all of our assets or stock, public offering of securities, or steps in consideration of such activities (e.g., due diligence). In these cases, some or all of your Personal Data may be shared with or transferred to another entity, subject to this Privacy Policy.

3.4 International Transfer

Information submitted to Harley AI will be hosted on servers located in the United States, and could potentially be processed on our servers elsewhere in the world where our data hosting service providers have servers. When you create an account with Harley AI or submit any personal data through the Service, you agree that we may transfer, process, and store your information outside of your resident jurisdiction. If you do not want your information to be transferred to or processed or stored in the United States, or any other country, you should not use the Service.

We endeavor to protect your personal data through a combination of technical, administrative, and physical controls, including encryption and access controls to our servers. However, no transmission over the internet can be guaranteed to be fully secure, and while we strive to protect your personal information, we cannot guarantee or warrant its complete security.

3.5 Retention period

Harley AI will process personal data for the duration of the service and will store the personal data for five years or as long as legally required or allowed. However, if you request, your personal data can be deleted according to the procedures set forth in Section 3.6.

3.6 Your rights as a data subject

As a data subject whose personal information we hold, you have the following rights:

  • Right to access: You have the right to request access to your personal data which we process.
  • Right to rectification: You have the right to require us to correct any inaccuracies in your personal data.
  • Right to erasure: You have the right to require us to erase your personal data, including your chat interactions with the Harley AI dating coach chatbot, and the unique client identifier stored in your browser’s local storage.
  • Right to restrict processing: In certain circumstances, you have the right to require us to restrict the processing of your personal data.
  • Right to data portability: You have the right to have your personal data transferred to another organization.
  • Right to object: You have the right to object to certain types of processing of your personal data, such as direct marketing.
  • Right to judicial review: If Harley AI refuses your request under rights of access, we will provide you with a reason why, and you have the right to complain.
  • Right to erasure: You have the right to require us to erase your personal data, including the unique client identifier stored in your browser’s local storage.

3.7 Complaints

In the event that you wish to make a complaint about how your personal data is being processed by Harley AI or how your complaint has been handled, you have the right to lodge a complaint directly with us at support@harley.coach.

4. Changes to the Privacy Policy

We may update this Privacy Policy from time to time. When we change this Privacy Policy in a significant way, we will notify you through an email or post a notification on our Site. We encourage you to review this Privacy Policy regularly to stay informed about our information practices and the ways you can help protect your privacy.
